Article 49 of the Spanish Constitution of 1978 obliges the state to protect and promote people with disabilities — at the time of its drafting, it was one of the few constitutional articles worldwide to explicitly enshrine such rights. For a long time, however, its wording lagged behind social developments: the original text still used the term "disminuidos" ("diminished"), a word widely seen by those affected as stigmatizing. After years of advocacy by disability organizations and broad parliamentary support, Article 49 was reformed in 2024. The new wording places inclusion, autonomy, and full social participation at its center — aligning with the UN Convention on the Rights of Persons with Disabilities, which Spain had already ratified in 2008.

With around 4.8 million people with recognized disabilities, Spain is among the EU countries where inclusion is strongly present both socially and legally. Institutions such as ONCE, the Spanish organization for the blind, have shown for decades that consistent support can enable economic independence and social integration. The 2024 constitutional reform marks a turning point: for the first time, disability is defined not as a matter of welfare but as a question of civil rights and active participation. Spain is issuing a 2-euro commemorative coin in 2026 to mark this step, placing the reformed Article 49 at its center.
